Under the Americans with Disabilities Act (ADA), if you have business that is open and accessible to the public, you are required to continuously monitor and maintain accessible public spaces and have policies in place to address complaints related to accessibility and accommodations for individuals with disabilities. Failure to implement such policies can result in significant legal repercussions, including punitive damages. These damages are intended to punish the entity for acting with malice or reckless indifference to the federally protected rights of individuals with disabilities.
For example, if a hotel ignores or inadequately responds to a guest's request for reasonable accommodation, it may be found in violation of the ADA. A case involving Ameriport, LLC, and Ocean Properties, Ltd., illustrates the severity of such violations. The companies were ordered to pay $650,000, including $500,000 in punitive damages, for failing to accommodate a wheelchair user's request for accessible entry doors. The jury found that the companies acted with reckless indifference, highlighting the importance of proactive compliance with ADA requirements.
In legal terms, compensatory and punitive damages can be awarded in ADA cases where there is intentional discrimination or failure to provide reasonable accommodation.
